Social legislation/Social fundamental rights/Fundamental rights/Constitutional jurisdiction/Böckenförde: Thesis: Fundamental social rights fail if they are clothed in the form of "genuine" fundamental rights, since they ultimately put constitutional jurisdiction in the role of the legislature. (1)
Solution/Böckenförde: on the other hand, the constitutionally appropriate formulation of social objectives is in state objectives and legislative mandates, which are by no means non-binding and which are primarily directed at the legislative and executive branches.
